The DUI law varies in every state. In California, the DUI law
(driving under the influence) states it's illegal to operate a vehicle while
under the influence of not only alcohol but drugs as well. Under the DUI law,
anyone under the age of 21 cannot operate a motor vehicle with a blood alcohol
content of over 0.01%. The DUI law also states that if you are using over-the-counter
medication, prescription medication or even drugs with alcohol in them such
as cough syrup and it is affecting your ability to adequately control your vehicle,
you can be charged with a DUI. The DUI laws have different penalties depending
on factors such as past DUI charges, your age and what type of license you may
have. Under the DUI law, you could face a license suspension, a fine and even
jail time. You may also have to attend DUI School or even have an ignition interlock
device installed in your vehicle. DUI convictions will remain on your driving
record for 10 years. For people with a commercial license, the DUI law states
that a blood alcohol content of 0.04% or higher will result in a DUI charge.
For drivers under the age of 21, the DUI law states they cannot have a blood
alcohol content over 0.01% and will also be charged with possession of alcohol.
